Rental Terms
All car rentals are governed by a comprehensive Rental Agreement, which will be provided upon booking confirmation or at the time of vehicle collection. This document outlines the terms, conditions, insurance information, and your responsibilities related to the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will be the authoritative document.
Eligibility Criteria
Requirements for Vehicle Rental
- To rent a vehicle from Gainsborough Car Hire, drivers must be at least 21 years old, although age restrictions may vary depending on the vehicle type. A valid driving licence appropriate for the vehicle category is required, along with proof of current address and identification. Additionally, valid payment information and a security deposit must be provided. Any further requirements outlined in the Rental Agreement must also be met.
Booking and Payment Process
- Reservations can be arranged via our website, by telephone, or at our Gainsborough office. A deposit may be necessary to confirm your booking. The remaining balance and security deposit are generally payable upon vehicle pickup. All charges are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, ensuring secure transactions through trusted payment platforms.
Vehicle Pickup and Drop-off
- At the time of collection, it is your responsibility to conduct a thorough inspection of the vehicle and promptly report any pre-existing damage. A vehicle condition report will be completed and both parties will sign it. When returning the vehicle, please ensure it is in the same condition as when it was collected, allowing for normal wear and tear. Any new damage will be evaluated and charged accordingly. The vehicle should be returned with the same fuel level as it was provided; otherwise, refueling charges will apply. Late returns may result in additional fees, so please inform us as soon as possible if you expect to return the vehicle later than agreed. You will be liable for any parking fines, traffic violations, or other charges incurred during your rental period, along with a related administration fee.
Insurance and Liability Terms
- All rentals come with basic third-party insurance included. You can find comprehensive coverage details and excess amounts in your Rental Agreement. Additional insurance options may be offered to lower your financial responsibility. It is wise to review these options closely. You will be liable for any damage or loss up to the insurance excess amount unless you have secured additional coverage. Damage resulting from negligence or misuse remains your responsibility, regardless of any insurance policy.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice given. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that canceling late or not showing up may incur additional fees.
7. Restricted Activities
Prohibited Uses of Your Rental
- The vehicle may not be used for any unlawful activities. Activities such as racing, rallying, or off-roading are prohibited. Transporting hazardous materials is strictly forbidden. Sub-letting the vehicle or permitting unauthorized drivers is not allowed. Operating the vehicle under the influence of drugs or alcohol is unacceptable. Use must align with the vehicle's intended purpose, and adherence to passenger and weight limits is required. Driving beyond the agreed geographical boundaries without prior consent is also prohibited.
Breach of these terms may lead to rental cancellation and extra fees.
8. Liability Limitations
To the fullest extent allowed by English and Welsh law, Gainsborough Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business related to your use of our services. Our total liability for any claims will not exceed the rental amount paid in the previous 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraud.
9. Legal Framework
These Terms are regulated by the laws of England and Wales. Any disputes will be resolved exclusively through the courts in this jurisdiction.
10. Updates to Terms
We reserve the right to update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
